Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday. The House must agree to these amendments before they go to the President and I do not yet know whether the bill will go back to the House...

Here is the testimony of DHS and commerce secratry before the Judiciary committee on 02/28/07. Not much talk by DHS secretry regarding high skilled immigration. They maily talk about border reinforcement and illegal aliens.

I have filed for the 7nth year extension based on my pending labor (365 days old). The perm is picked up for an audit. Incase if the perm is denied, will h1b also be rejected ?
As per my understanding, your H1 will not be denied but you will not be eligible for any subsequent extensions unless at that time you have one more perm pending for over 1 yr or I-140 approved.
I would recommend you find another employer or file perm through some one else as future employee. 30% perms in audit are denied after 2 yrs wait.

My I485 application was received at the Texas center on Nov 6th. No receipts yet and checks have not cashed, although the USCIS website says it is current for receipts. Anyone in my situation?

Hi Guys
My I-140 cleared on last month, also I applied for 3 year's visa extension, got receipt. Now I want to change company, I got a got offer from a big company. My question is
1. If I'll apply H1-b from new company , how many years visa I'll get(With current I-140)?
2. Is it possible to keep PD of my current GC (Aug'03)? even in case of my current company revoke/use my GC?

hello, i really need some one to clarify this information for me.
when i first started working with my company i did not have work authorization and basically said i am a US citizen, i never had any problems for 4 years, i am a permanent residence now and got my green card this year. the company now nows that i lied 4 years ago when i got hired and i was not allowed to work but am fully eligible to work now becaue of change in status to PR. can the company resubmit a new i9 form with the correct information and if i will be in any trouble with USCIS.
What is the law for someone who worked illegaly but got his or her status changed to PR.

As of July 24, 2009, approximately 44,900 H-1B cap-subject petitions have been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption have been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.
