Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?
Please help!
I don't think so. One of my friend is in same situation. I feel 485 is filed after H1b so every thing is fine. But on which boat they need to travel is the question? you can't use H1 if you use EAD?

The Center for American Progress has released a report that urges an end to the "arbitrary restrictions" on H-1B visas and replacing the 65,000 quota with a market-based system where numbers rise in a strong economy and drop in a weak one. The report also recommends stronger enforcement mechanisms to prevent fraud and abuse.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

I spoke with TSC Rep today. I called up to re-check what lot of other guys are saying here that TSC no longer is honoring 180 day namecheck rule mandated by court few months back.
TSC Rep said she has no idea about 180 day rule but knows about FBI/USCIS joint effort for clearing name checks pending more than year, 2 years etc.
So atleast, my call suggested that some people at USCIS have no idea about 180 days rule mandaged by court.

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

Guys, Assuming that everyone from July Filers group went through FP for AOS once at that time, do they need to go again to get the AOS approved now? My question is ppl who r being approved these days and if they r july filers, did they go for 2nd FP? Can uscis use FP of EAD in 485 ?

Hi friends,
I got my I-140 approval in premium processing. But unfortunately, USCIS printed the new labor filing date (2010) when the attorney requested my I-140 to capture the old priority date which is June2004. My law firm already contacted USCIS to issue a revised notice with the old priority date (June2004).
How long does USCIS take to issue a revised I-140? Any feedback is greatly appreciated. Anything that we can do to expedite the release of the new I-140 notice with correct priority date?
Please let me know when you get a chance

I have renewed my AP third time now; All three time AP went to lawyer; This time it was a record 15 days for AP approval. USCIS is getting it done superfast looks like.
EAD always came directly to me. (Never in DHL- probably a special case????)

was here in the US in B2 visa. I applied for change of status (to F-1) and after waiting for several months, they told me that my request has been denied. What are the options that I have if I still want to stay in the US
