as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

Is there any one in this situation?
1. Date is current(because of interfile) and received 2 year EAD
2. USCIS District Office IO cannot find whether the case is EB2 or EB3. Is it true or there any experiences?
3. Does any one know of any pattern of how long it will take to approve the case once its assigned to an Office?
Any input is greatly appreciated.

My biometrics appointment is scheduled at ATL ASC on the 19th of this month which is a Saturday. Has anyone on this forum visited ATL ASC for any work on a Saturday? Should I call up the USCIS customer service to reschedule my appointment? Or, do I need to be happily surprised to see my the USCIS working hard for me even on a weekend? ( The later part sounds like a 'Bizzaro World' from Seinfeld )

its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....

Hi,
Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:
Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.
My questions are this:
1.) When I enter US back in with my AP in Jul 11, will that impact my H1B extension in any way.
2.) Without any EAD will I be Jeapordizing my AOS in any way.
I will be continuing to work with the same employer who is the sponsor of my current
I485.
Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

As I understand , either there would be no bulletin revision(currently appearing impossible) or there would be a bulletin revision making some categories unavailable , in which case it doesnt matter even if your application has made it on July 2nd it will be returned. So why is the rush to get applications by mail/fedex/samedaydelivery/inpersondelivery/etc ?
Or is the rush to deliver only for those applicants with PDs in 2002-2004 who are hoping that their PD will make it in the new bulletin if it is not unavailable? I see no reason for the rush which seems to have increased after the rumor about the new bulletin on friday ...(although I personally asked my lawyer to send it on friday 6/29 and for which I have no confirmation if it was actually sent or not).

I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.
Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

You are only counted against the quota once for a 6 year period , so I believe, she won't come under the quota , although it's getting harder to get H1B extensions every day

I had filled my & my wife's 485 on July 16th 2007. However I noticed that the check that I had sent for my 485 had a minor overwriting in the amount field. I had filed for my wife's H-4 extension last month with a similar issue in the check and the USCIS has sent the H-4 application back. Obviously, I do not want the 485 application to be rejected. So i need urgent help on this matter from you all immigration experts, please help me weigh my options:
1.) Can I refile 485 for me and my wife? Is it possible to have 2 485 applications for a person.
2.) If I refile, and then the USCIS accepts my first application, then will loose the fees for second application or will it be refunded?
3.) Do you think I will simply be asked for another check if I dont refile (which I really doubt.)
I know the mistake might sound stupid but Please guide me in this dilemma. Any help will be greatly appreciated.

I wish to share my experience at POE at Newark Liberty International Airport. This may be helpful to others.
I came back to US on last Sunday on AP/EAD.
There was no issue at all while entering on AP. In fact, there were several AP/ h1B candidates. Everyone was having smooth entry.
Immigration officers were asking everyone to relax and calm down.
One person ahead of me had first and last name completely switched on I-485 and EAD than from passport.
He explained that his first and last name got switched while GC filing.
After little investigation , he was also allowed to enter by immigration officers.
Overall my experience was very good about immigration at POE.
No need to afraid if we have proper documentation.
People are unnecessarily spreading panic and rumours.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..
