    I am filing for I-485 for my wife based on my approved I-140 and pending I-485 (EB2). Under part 2 which option i should chose for her.

    Folks please advise on using POJ method. I tried calling using the instructions below however I always get to customer service instead of NSC where I intend to connect. Am I missing something here ?

    Call 1-800-375-5283
    Press 1 to select English
    Press 2 to skip introduction
    Press 2
    Press 6 to find case status information
    Press 1
    Now enter your receipt number SRCxxxxxxxxxx
    Voice asks if SRC press 1
    Then reads out application number, if correct, press 1 (now listen to the case update info..blah blah)
    Part way through the blah blah press 3
    Wait a moment and press 4

    I am July 2 filer with Nov 2005 PD EB2-I. Even though I'm happy for others It is indeed frustrating to see my case languish like this. No updates at all. CSR just tells me to wait and wait forever. Opened an SR but nothing happened yet. Very very demoralizing....

    No need for exp certificate in applying for H1.

    At embassy/consulate, for visa stamping, you should keep it as they may like to verify. It is not mandatory but good to have.

    Please give me some advice on my situation,

    My mother had green card through my sister who is US Citizen. four years ago my mother wen to India and did not came back. after 6 years she again came back on visitors visa.

    we want to renew her greencard.

    Please advise if it is possible of we have to start new process?

    I've found this site to be very helpful so far and would like to ask for some opinions on my case.

    My I-485 (EB2) was submitted in 2007 and the PD is approaching, only 5 days away based on June's VB. My girlfriend is currently with F-1 visa and we are planning on getting married asap so that she can submit her 485 before my case is approved.

    Here's the complete list that I can think of based on the research that I've done.

    Documents that my future wife's need prepare

    I-485 form
    birth certificate
    marriage certificate
    medical exam
    passport pages (I-94 card ect)
    I-20 form
    Two photos


    Documents that I need prepare

    My I-485 receipt
    ????

    It is very important to get married before your GC is approved. Even if you are 1 day late, you cannot file I-485 or follow to join. So its better to get married before June 1st to remove any such risk. Good luck!

    Hey,

    I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.

    Hope this helps. I understand this might not be the case for all but it worked for me.

    We went for FP today and my wife had henna on her hands. I was concerned about it but it never was an issue. The FP went as if she had nothing on her hands instead the FP people pleasently talked abt henna.

    We went to the Atlanta office, the staff was pleasent, work flow streamlined and we were done in less than an hour although they looked and checked our hands almost four times for bandages and cuts.

    Question:

    H1B: 4th year running
    GC process: 140 filed, waiting for priority date to become current and then apply for I-485
    Priority date is Oct 2007, so not expected to be current this year.

    Can I apply for F1 starting next year? This is for an MBA course.
    What are the risks involved?

    Dear friends,

    I received card production e-mail today.

    My PD June 2007, RD Oct 2007. No REFEs. EB1 India.

    Thanks for all the help and good counsel.

    Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.

    In this process, I made so many friends and learned to heed others views and good advice.

    Will continue to work for IV.

    If you are going to Nogales after 7th year extension, even if you get 3 years of h1, Nogales consulate gives visa for 1 year.

    I have talked to Visa Officer he refused to give me for 3 years and he told me that it is the policy of Nogales consulate.

    Friends,

    We are future permanent residents waiting in queue, for sure many of us are going to get GCs in few weeks/months/years. Considering this situation lawmakers can give us a chance to get the GC faster than waiting in the queue just by buying a house. But still they are searching for another solution than which could be effective.

    Hello,

    I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

    Like many others, I was also unable to file my I-485 after the July 2 fiasco. My lawyer front-desked my application yesterday to ensure my eligibility for the class action. But he sent my application to the Texas Service Center instead of the Nebraska Service Center as was insructed in the form. Also, my employment letter was addressed to the Nebraska Service Center. His reasoning: my I-140 was approved by the Texas Service Center. Also, my name was spelt wrong on the FEDEX tracking system. Will USCIS reject it because of filing at the wrong service center...if so then will I lose my class status? Please shed some light.

    USCIS recently issued a Memo that amends Adjudicator�s Field Manual on General Form I-140 Issues. Many issues are covered, but one of particular interest to our PERM (http://www.h1b.biz/lawyer-attorney-1135851.html)readers is the Labor Certification Validity for Labor Certifications with an Ending Validity Date that Falls on a Saturday, Sunday or Federal Legal Holiday.

    DOL has established a 180-day validity period for approved labor certifications. See 20 CFR 656.30(b). An approved labor certification must be filed in support of a Form 1-140 petition during the labor certification's validity period. DOL has not published any guidance regarding the treatment of labor certifications that effectively have a validity period of less than 180 days due to an ending validity date that falls on a Saturday, Sunday, or a federal legal holiday.

    USCIS will accept the filing of 1-140 petitions where the supporting labor certification validity period ends on a Saturday, Sunday or federal legal holiday on the next business day, i.e., the next day that is not a Saturday, Sunday or federal legal holiday. This action is most consistent with existing USCIS regulations, which allow cut-off dates for the filing of petitions and applications that fall on a Saturday, Sunday or federal legal holiday to be extended until the next business day. See 8 CFR 1.1 (h). This procedure provides petitioning employers the benefit of the full 180 day validity period for approved labor certifications established by DOL.
